Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the transportation services provided by Dark Horse Transport LLC DBA Dark Horse Black Car  ("Company"). By using our services, you agree to comply with these Terms. If you do not agree with any part of these Terms, you may not use our services.

2. Services Provided

The Company provides luxury black car transportation services using well-maintained Cadillac Escalade SUVs. Our services include transportation to and from airports, hotels, venues, and other destinations as requested by the client.

3. Booking and Payment

Clients may book transportation services through our website, mobile app, or by contacting our customer service team. Payment is due at the time of booking and can be made via credit card or other accepted payment methods. Prices are subject to change and may vary based on factors such as distance, time of day, and additional services requested.

4. Cancellations and Refunds

At Dark Horse Black Car, we recognize that circumstances can change unexpectedly, and we are dedicated to accommodating our clients to the best of our abilities. Reservations cancelled between one week and up to 48 hours before the scheduled pickup time will incur a charge equivalent to one hour of minimum vehicle reserve service time. Cancellations made within 48 hours of the scheduled pickup time will result in the full reservation amount being charged, unless extenuating circumstances arise, which will be assessed on a case-by-case basis.
 
In the event that you foresee the need to modify your reservation, we kindly request that you inform us as soon as possible to avoid the possibility of being booked out on new date or time. Reservations cancelled prior to one week before the scheduled pickup time will be able to request a full refund less a $30 administration fee. Please contact our administrative staff to request the refund. Rest assured, we are fully committed to providing exceptional service and will make every effort to accommodate your requirements. Your satisfaction is paramount to us, and we sincerely appreciate your understanding in this matter. 
 
At Dark Horse Black Car, we pride ourselves on offering cutting edge services enhanced by state-of-the art booking software. Our advanced system allows us to provide real time tracking of flights and notifies us of any changes to your itinerary when provided with airline and flight number. However, while our software serves as a valuable tool to assist our drivers, it is imperative for our clients to inform us directly of any changes to their travel plans. 
 
Please note that while we utilize the latest technology to enhance our services, our booking software is not infallible and should be viewed as an aid rather than guarantee. In cases of extreme itinerary changes or unforeseen circumstances, we reserve the right to assess the situation and may regrettably need to deny service due to prior bookings or logistical constraints. Depending on the circumstances we will credit or refund your account as deemed necessary. 
 
Rest assured, our primary goal is to provide our clients with seamless and stress free transportation. We appreciate your corporation and understanding as we strive to deliver exceptional service tailored to your needs. 
 

5. Client Responsibilities

Clients are responsible for providing accurate booking information, including pickup location, destination, and desired pickup time. Clients must also adhere to any safety instructions provided by the driver during the course of the journey.

6. Driver Conduct

Our drivers are professional, discreet, and committed to providing a safe and comfortable experience for all passengers. Clients are expected to treat drivers with respect and refrain from engaging in any behavior that may compromise the safety or well-being of the driver or other passengers.

7. Liability

The Company is not liable for any damages, losses, or injuries incurred during the provision of transportation services, except in cases of gross negligence or willful misconduct on the part of the Company or its employees.

While Dark Horse Black Car prioritizes the safety and well being of our clients, we advise every passenger to wear a seat belt during their journey with us. However, it is ultimately the responsibility of each client to decide whether to utilize this safety measure. Dark Horse provides working seat belts in an each vehicle in our fleet. 

By using our services, clients acknowledge that Dark Horse Black Car shall not be held liable for any damage, injuries, or losses resulting from failure to wear a seat belt or comply with other safety measures. Clients agree to assume all risks associated with their decision not to wear a seat belt. 

We adhere to all applicable laws and regulations governing passenger safety, and our drivers are trained to prioritize the safety of all passengers. However, in the event of any unforeseen circumstances or accidents, Dark Horse Black Car shall not be held liable for injuries or damages resulting from failure to wear seat belt or properly use seat belts provided. If you have questions on how to use the seat belts please ask your driver and they will be happy to assist you. 

Your safety is out top priority, and we appreciate your cooperation in adhering to safety guidelines during your journey with us. 

8. Child Seat Restraints

Dark Horse Black Car offers rental child seats to clients upon request. It is the responsibility of the client to insure proper installation and correct strapping in of children using the rental child seat. Clients acknowledge and agree that Dark Horse Black Car shall not be held liable for any injuries, damages, or losses resulting from the improper installation or use of rental child seat.  It is the companies responsibility to make sure said car seats are not expired and meet all recommend safety standards. It is the clients responsibility to inspect the car seat upon rental and may request the manual if needed for installation. 

Clients understand that Dark Horse Black Car does not provide installation services for rental child seats and that responsibility for installation lies solely with the client. 

By requesting a rental child seat from Dark Horse Black Car, clients assume all risks associated with the use of the rental child seat and agree to indemnify and hold harmless Dark Horse Transport LLC DBA Dark Horse Black Car for any claims, liabilities, damages, or losses arising from improper installation or use of rental child seat. It is the clients responsibility to ensure compliance with all applicable laws and regulations regarding child passenger safety during transportation with Dark Horse Black Car. 

9. MISC

All deposits are NON refundable. Company is not liable in the event of mechanical breakdown while on charter and will only be responsible for making up lost time at a mutually agreed date. The client assumes full financial liability for any damage to the vehicle caused during the duration of the rental by them or any members of their party. A fee of 150.00 for each carpet or seat burn. Sanitation fee is 350.00.  Illegal drug use is prohibited by law. Any fines will be paid for by the customer. The driver has the right to terminate run without refund (if there is blatant indiscretion on the part of the client(s)). It is Illegal to stand through the sunroof. Smoking is not permitted in our vehicles ever including vaping devices.  Overtime pay will apply after the first 15 minutes of prearranged time described on the run sheet. Not responsible for delays or  termination of reservation in winter caused by unsafe road conditions (ie. not salted, accidents, etc.). Not responsible for articles left in the limousine. Balances to be paid to the driver on the run date before the beginning of the run. Vehicles cannot be loaded beyond seating capacity.

10. Privacy

The Company respects the privacy of its clients and is committed to protecting their personal information. Please refer to our Privacy Policy for more information about how we collect, use, and protect your data.

11. Amendments

The Company reserves the right to amend these Terms at any time without prior notice. Any changes will be effective immediately upon posting on our website or notifying clients via email.

12. Governing Law

These Terms are governed by the laws of The State of Montana. Any disputes arising out of or related to these Terms shall be resolved through arbitration in accordance with the rules of Montana Academy of Mediators & Arbitrators with the venue in Flathead County, Montana. 

By using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
